Terms and Conditions
The Kennel Club Ltd is a limited company registered in England and Wales under company number 08217778 and has its registered office at 10 Clarges Street, Piccadilly, London, W1J 8AB
and conditions are for the use of the Kennel Club Academy.
Any submission of material by you means that you accept and agree to abide by all the terms and conditions.
The Kennel Club, referred to
as “the KC” throughout may revise these terms and conditions at any time. You
should visit this page periodically to review the terms and conditions because
they are binding on you. Continued use of the Kennel Club Academy constitutes
your agreement to all such revised terms and conditions.
The purpose of the Kennel Club Academy learning resources is to set standards in all areas of canine activities through a comprehensive canine education programme.
The KC may, in its absolute and sole discretion, at any time terminate and/or cease to provide the services, including without limitation where:
(a) the KC decides to discontinue its online education programme;
(b) the KC is unable to procure the provision of the services pursuant to a legally binding contract with a service provider.
It is hoped
that users will provided feedback and participate from time to time in such
activities (such as completing questionnaires or responding to queries from the
KC or the service provider) as KC may reasonably require in order to evaluate
the effectiveness of the on line learning services.
Modifications to content of existing courses or technology enhancements/Updates
From time to time, the KC may make modifications, enhancements or issue clarifications (for example, to clarify ambiguous regulatory drafting) to the audio visual, interactive or written learning resources. Access to such changes is free of charge only to the extent that such changes relate to the learning resources purchased.
Certain learning resources will periodically be superseded by the issue of new regulations. Following the issue of new regulations, the KC may produce updated learning resources covering the new material. Updates will be available as part of any learning resource previously purchased. Updates will not affect previously successful assessments based upon earlier versions of a particular learning resource.
Use of Learning Resources

You undertake that you will:
a. not use nor interfere with the website so that all or part of the website or any material is or could be interrupted, reproduced, stored, retransmitted, published, damaged, rendered less efficient, corrupted or in any way impaired;
b. not gain unauthorised access to the website, the server on which the website is stored or any server, computer or database connected to the website;
c. not introduce viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful;
d. not sell, publish or modify the material or reproduce, display, publicly, perform, distribute, store, retransmit or otherwise use the material in any way for any public or commercial purpose or at all;
e. not send a message or communication which is offensive, abusive, defamatory, obscene, menacing or illegal or likely to be detrimental to the reputation of the site;
not impersonate any person, or misrepresent
your identity or affiliation with any person.
g. not share your login details and allow use by others;
h. ensure your content will be accurate and relevant;
i. not undertake an online assessment with assistance from others but will complete the assessment as your own independent work;
j. not share reproduce or disclose the assessment format or content to others.
The KC’s Liability
The KC makes no representations about the accuracy, reliability or completeness of the material or any reliance by you on the website and the learning resource material.
The KC cannot be held responsible for any delay or disruption to your access to the learning resources as a result of such suspension or any of the following:
a. the operation of the internet and the world wide web, including but not limited to viruses;
b. any firewall restrictions that have been placed on your network or the computer you are using to access the online course;
c. failures of telecommunications links and equipment; or updated browser issues.
The website and material are provided on an “as is” basis without any warranties of any kind. The KC and its suppliers, to the fullest extent permitted by law, disclaim all warranties, including the warranty of merchantability, non-infringement of third parties' rights, and the warranty of fitness for particular purpose. Nothing in these terms and conditions is intended to exclude or restrict the KC’s liability to you for death or personal injury resulting from negligence; or (b) where such liability arises from any dishonesty committed by the Kennel Club.
The KC will use reasonable endeavours to make the learning resources available but cannot guarantee uninterrupted, timely or error free availability.
The KC reserves the right to suspend access to the website for the purpose of scheduled or emergency maintenance, repairs or upgrades to improve the performance or functionality of the online hosting platform.
It is acknowledged that periods of downtime may be required in respect of the information technology infrastructure connected to the online courses and that technical support may not be available during such periods of downtime.
Links to Other Sites
The Website may contain links to third party websites. These links are provided solely as a convenience and not as an endorsement by the KC of the contents on such third party websites.
The KC is not responsible for the content of linked third party sites and does not make any representations regarding the content or accuracy of materials on such third party websites. Any access linked third party websites, is at your own risk.
You may enter into or seek to enter into transactions with third parties in relation to the material via the website. The KC will not be a party to such transactions and will not be liable whether in contract, tort (including liability for negligence), or otherwise for any loss, cost of damage incurred arising out of or in relation thereto.
At all times, the KC and/or its licensors, remain the owner of the intellectual property in the learning resources. No learning resource nor any part thereof may be reproduced, stored in a retrieval system or transmitted any form or by any means without the prior written permission of the KC.
Use of the learning resources not expressly permitted in these terms is strictly prohibited and will constitute an infringement of either the KC’s copyright or the KC’s other intellectual property rights, and / or the copyright or other intellectual property rights of the KC’s licensors.
Save as expressly set out in these terms, you may not modify, copy, reproduce, re-publish, sub-licence, sell, upload, broadcast, post, transmit, make available, disseminate or distribute in any way any of the study materials. You may not modify, adapt, merge, translate, disassemble, decompile, recompile or reverse engineer any software forming part of the online study materials or create derivative works based on the whole of or any part, or which incorporate, the online study materials into any software program.
In consideration of receipt by the KC of the fee, the KC grants to you a non-exclusive, non-transferable licence to use the study materials and content for the sole purpose of studying for the learning resource. The licence granted is to use the learning resources on one computer only.
By submitting any material to the website, you agree to grant the KC an irrevocable, free of charge, non-exclusive, worldwide, perpetual license to use your content and the unrestricted right to freely use, edit, alter, reproduce, publish and/or distribute the content for any purpose commercial or otherwise. This licence will be free of charge, perpetual and capable of sub-licence. The KC may exercise all copyright and publicity rights in the material contained in your contribution in all jurisdictions, to their full extent and for the full period for which any such rights exist in that material.
Use of Personal Information
The KC may use your information to process your requests for learning resources, products or services, provide access to privileged areas of the website, to administer contests and competitions, personalise your visit to our site and to enable us to review, develop and improve the products, services, and special offers we provide online. The KC may occasionally carry out market research and send you details of services and offers that we think will be of interest to you. If you do not wish to receive such information, please let us know in writing.
Use of your data and content for research
The KC and our partners carry out studies of learner activities and content for academic research, to understand the learner experience, and to improve our courses.
All research studies by us and our partners includes a commitment to maintaining all data that can identify learners in secure locations and only to conduct research on anonymised data. Neither the KC nor our partners will sell or give to any other party data that identifies individual learners.
You consent that the KC and our partners may conduct research studies that include anonymised data of your interactions with the website, including learner content.
The learning resources are for training purposes only. The KC will not accept any responsibility to any party for the use of the tuition provided and/or the contents of the study materials for any purpose other than training for educational purposes.
The KC will use such information including but not limited to:
a. perform its obligations and enforce its rights under these terms;
b. contact you by email, telephone or post to inform you about other products or services which may be of interest to you;
c. inform you of feedback and examination results;
d. the KC may share your information with its agents and service providers for these purposes.
Breach of these Terms
If we consider that a breach of these terms and conditions has occurred, we may at our discretion take such action as we consider appropriate. Failure to comply with these terms may constitute a material breach such terms and may result in the immediate, temporary or permanent withdrawal of your right to use the courses and your account may be disabled.
If any provision of these terms and conditions is held to be illegal, invalid or unenforceable in whole or in part the remainder of these terms and conditions will continue to be valid and enforceable. No failure or delay in exercising rights under these terms and conditions shall operate as a waiver of such rights. These terms and conditions will be governed by English law. The courts of England have exclusive jurisdiction over any disputes arising in connection with these terms and conditions.
